PRELIMINARY INFORMATION

1. Introduction

This document (together with all other documents referred to below) sets forth the terms and conditions governing the use of the website and the purchase of products through it (referred to below as the "Terms"). Customers are required to read these Terms, our Cookie Policy, and our Privacy Policy (collectively, the "Data Privacy Policy") before using the website. By using this website or placing an order through it, you, our valued Customer, acknowledge, represent, and agree to be bound by these Terms and the Data Privacy Policy. If the Customer does not accept all of the Terms and the Data Privacy Policy, they should not use the website. These Terms and the Data Privacy Policy are subject to change. It is the Customer's responsibility to read them regularly, and the Terms and the Data Privacy Policy in effect when the Customer uses the website or forms the Agreement (as defined below) will apply to the Customer.

2. Information on the Website and Your Visits

To purchase the desired product, the customer must share their personal information. The information or personal data you share with shopderin.com is processed in accordance with our Data Privacy Policy. By using the website, the customer confirms that all information shared with shopderin.com is accurate and true, and thus agrees to the processing of this information and personal data. If the customer expresses their interest to shopderin.com, shopderin.com may inform the customer via email about the latest collections, catalogs, campaigns, and special offers.

3. Use of the Website

By using the website and/or placing an order through the website, the Customer acknowledges, represents, and agrees to: 1. Use the website only for legitimate requests or orders, 2. Not place unrealistic, false, or fraudulent orders; 3. Provide shopderin.com with accurate and up-to-date email, postal, and/or other contact information, and that shopderin.com may use this information to contact the Customer if necessary. (See Data Privacy Policy). If the Customer fails to provide shopderin.com with all the information needed to complete the order, shopderin.com may not complete the order. By placing an order through the website, the Customer confirms that they are at least 18 years of age and legally capable of entering into a contract.

4. Availability of Services

The products offered on this website are only suitable for delivery within the borders of the Republic of Turkey.

5. Establishment of the Contract

To place an order, the Customer must follow the online purchasing process and click "Confirm Payment." Upon completion, the Customer will receive an email confirming receipt of the order ("Order Confirmation"). A subsequent email will notify the Customer that the order has been accepted and is being shipped ("Delivery Confirmation"). If shopderin.com does not provide such confirmation to the Customer, the Contract is deemed not to have been formed.

6. Product Availability

All orders are subject to availability. In the event of supply shortages or if a product is no longer in stock, shopderin.com reserves the right to inform the Customer of substitute products of a similar or different category and value that the Customer may order. If the Customer does not wish to order the substitute product, shopderin.com will refund the amount paid for the unwanted substitute product.

7. Rejection of Order

shopderin.com reserves the right at all times to withdraw any product from its website and/or to remove or correct any material or content on its website. While shopderin.com will use all reasonable efforts to process all orders submitted to it, it reserves the right at all times to refuse to fulfil or confirm an order if exceptional circumstances arise after it has received an order or sent the Order Confirmation to the Customer. shopderin.com shall not be liable to the Customer or any third party for withdrawing any product from its website, removing or correcting any material or content, or refusing to fulfil or confirm an order after it has received an order or sent the Order Confirmation.

8. Delivery

Subject to stock availability (see item 6 above) and unless there are any exceptional circumstances, shopderin.com will deliver orders for products listed in the Delivery Confirmation by the delivery date specified in the Delivery Confirmation, and orders without an estimated delivery date within a maximum of (thirty) 30 days from the Order Confirmation date. If the supply of products is delayed due to a circumstance beyond shopderin.com's control, shopderin.com will notify the Customer as soon as possible and will take steps to minimize the impact of the delay.

9. Failure to Deliver

If delivery is not possible, the product(s) will be returned to the warehouse. If delivery is not possible, the Customer will be informed of the location of the ordered product and how to rearrange delivery. If the Customer is not available for delivery at the agreed time, they must contact shopderin.com to rearrange delivery on another convenient date to be agreed upon. If the ordered product is delivered to the delivery address but is not delivered for a reason not attributable to shopderin.com, and the Customer fails to contact shopderin.com within fifteen (15) days of the delivery date, the Customer will be deemed to have acted in breach of this Agreement and the Agreement may be terminated. As a result of termination of this Agreement, shopderin.com will refund all payments received from the Customer, including the cost of delivery (excluding any additional costs arising from any delivery method requested by the Customer other than the standard delivery method offered by shopderin.com), to the Customer without unreasonable delay, and in any event, within fourteen (14) days of termination of this Agreement. The Customer should note that there may be additional shipping costs resulting from the termination of the Contract, and shopderin.com reserves the right to pass these costs on to the Customer. This clause does not apply to virtual gift cards, as the delivery of virtual gift cards is subject to the Gift Card Terms and Conditions and the provisions of clause 8 above.

10. Risk and Ownership

As long as the Customer accepts delivery by the courier/cargo company designated by shopderin.com, all damage and loss related to the products until delivery will be the responsibility of shopderin.com. Ownership of the products passes to the Customer upon delivery to the Customer or the person at the delivery address (transfer of ownership).

11. Price and Payment

The prices of the products are as set forth on the website. While shopderin.com makes every effort to ensure that all prices on the website are accurate, errors may occur. If an error is detected in the price of the products ordered by the Customer, shopderin.com will notify the Customer as soon as possible and offer the Customer the option to confirm the order at the correct price or cancel the order. If shopderin.com cannot reach the Customer, the order will be deemed canceled and the amount paid for the products will be refunded to the Customer. If the pricing error is obvious and definitive, and the product price listed on the website is clearly incorrect, shopderin.com will not be obligated to complete the sale of the products to the Customer at the incorrect (or lower than would otherwise be the case) price (even after sending the Customer a Delivery Confirmation). Prices on the website include VAT and taxes, but do not include delivery costs. This fee will be added to the total price as specified in the Shopping Guide to determine the total order price. Prices are subject to change at any time, but (except as noted above) price changes will not affect orders once an Order Confirmation has been sent to the Customer. Therefore, prices for previous orders are not allowed to be adjusted (except as noted above). When the Customer completes their purchase, all products they wish to purchase are added to their shopping cart, and the next step is to finalize the order and make payment. To do this, the Customer must follow the steps of the purchasing process, completing or confirming the information requested at each step. Furthermore, the Customer may make changes to the order details throughout the purchasing process, prior to payment. After the order is completed and before the payment is confirmed by the Customer, the basic characteristics of the purchased product, the total price of the product including all taxes, where a right of withdrawal exists, the conditions for exercising this right, its duration, procedure, and the carrier designated by the Seller for returns. In exceptional cases where the right of withdrawal cannot be exercised, information regarding the circumstances under which the Customer cannot exercise the right of withdrawal or the circumstances under which the right of withdrawal will be lost, will be presented to the Customer in the form of an order summary. The Shopping Guide contains detailed instructions on the purchasing process. Furthermore, if the Customer is a registered user, details of all their orders can be accessed in the "My Account" section. Payments are made via credit cards and debit cards using the payment methods listed on the website and in the applications. 4. The Customer's credit card information is encrypted to prevent unauthorized access. When shopderin.com receives the Customer's order, an authorization is requested on the Customer's card to verify that there is sufficient available funds to complete the transaction. Payment will be collected upon confirmation by shopderin.com of the order. By clicking the "Confirm Payment" button, the Customer confirms and confirms that they are the owner of the credit card used or the legal holder of the gift card or credit card. Credit cards are subject to verification and authorization by the card issuer; however, if the Customer's card issuer fails to authorize payment to shopderin.com, shopderin.com will not be liable for any delays or non-delivery, and will not be able to complete the Contract.

12. Invoice

An invoice will be issued and sent to the Customer together with the delivered products at the latest. shopderin.com reserves the right to apply other procedures in accordance with e-invoicing legislation regarding invoicing.

13. Pay Now

The Instant Pay feature (hereinafter referred to as "Immediate Pay") simplifies the shopping process on this website by eliminating the need for the Customer to enter delivery, invoice, and payment information for each purchase. Instant Pay is available to the Customer in the View Cart section. To use the Instant Pay option, the Customer must save the credit and/or debit card information for payment. The Customer can perform this transaction by clicking "Save my card details" on any order when paying with any card accepted by shopderin.com. This saves the card number, the cardholder's name as it appears on the card, and the card's expiration date. The Customer will be required to accept the Data Privacy Policy and Terms and Conditions to save card information and use the Instant Pay feature. By agreeing to use the Instant Pay feature, the Customer authorizes shopderin.com to charge the card associated with this feature for purchases. Card use is subject to the terms and conditions agreed upon between the Customer and the card issuer in each case. With the Instant Pay feature, the Customer can save card information for as many cards as they want, but they must have made at least one payment with each card to do so. If the Customer wants to save card information for multiple cards, the most recently saved card will be the "Preferred Card," and by default, payment for Instant Pay purchases will be collected from there. However, the Customer can change the Preferred Card at any time in the My Account section of the website. To use the Instant Pay feature, the Customer simply clicks the "Checkout Now" button in the Shopping Cart section. Immediately after clicking the button, a screen containing the shipping, invoice, and payment information for the purchase will appear. The information displayed on this screen cannot be changed; therefore, if the information on the screen is incorrect, the Customer should not complete the purchase. To make a purchase using different information, the Customer should not use the Instant Pay feature. 6. The Preferred Card associated with Instant Pay can be changed in the My Account section of the website.

14. Value Added Tax

In accordance with the provisions of current legislation, all sales transactions made through the website are subject to Value Added Tax (VAT), except for applicable final exemptions subject to the Customer's approval.

15. Return Policy

15.1. Legal Right of Withdrawal Right of Withdrawal The Customer has the right of withdrawal within fourteen (14) days following the conclusion of the Contract, without stating any reason (except for contracts drawn up for product groups where the right of withdrawal specified in article 15.2 below cannot be exercised). Purchased products can be returned free of charge via Yurtiçi Kargo .

The withdrawal period expires fourteen (14) days after the Customer or a third party designated by the Customer (other than the courier) takes possession of the products, or, in the case of separate delivery of multiple products from a single order, fourteen (14) days after the Customer or a third party designated by the Customer (other than the courier) takes possession of the last product. To exercise this right of withdrawal, the Customer must notify shopderin.com of their wish to exercise their right of withdrawal and their decision to terminate the Agreement by written notice or other means provided on the website. The Customer may notify shopderin.com by sending an e-mail to info@shopderin.com. The Customer may also notify shopderin.com of their wish to exercise their right of withdrawal by sending a written notice to Yeni Mah. Filiz Sk. No:5 Urla İzmir (Branch).

Although not mandatory, the Customer may use the sample right of withdrawal form included in the Annex to these Terms and Conditions. To exercise the right of withdrawal in a timely manner, it is sufficient for the Customer to notify shopderin.com of their intention to exercise their right of withdrawal before the expiration of the period. If the right of withdrawal is exercised, the product may be returned to shopderin.com via courier within ten (10) days from the date of notification of the exercise of the right of withdrawal, in accordance with Article 15.2 of this Agreement. The refund will be made without any delay, no later than fourteen (14) days from the date of receipt of notification of the exercise of the right of withdrawal. Regardless of the Customer's chosen return method, if returns are not made by a courier chosen by shopderin.com, any additional costs incurred by shopderin.com will not be included in the amount to be refunded to the Customer.

Consequences of exercising the right of withdrawal If the Customer terminates the Agreement, except as otherwise provided in Article 17.2, shopderin.com will refund to the Customer all payments received from the Customer, including delivery costs (excluding any additional costs that may arise when a delivery type other than the least costly standard delivery type offered by shopderin.com is selected). shopderin.com will make the refund using the same payment method that the Customer used for the purchase, and in no case will the Customer pay any additional fees as a result of such a refund.

The customer must return the products to shopderin.com via the courier company designated by shopderin.com, without any delay and no later than ten (10) days from the date of notification of the exercise of the right of withdrawal. The customer must return or refund the products before the expiration of this ten (10) day period.

The Customer is only responsible for any decrease in value that goes beyond any control necessary for the nature, characteristics, and operation of the products. Cases where the right of withdrawal cannot be exercised: The Customer cannot exercise the right of withdrawal in contracts for the delivery of any of the following products:

1. Contracts for goods specifically prepared in line with the customer's wishes or personal needs.

2. Contracts regarding books, digital content and computer consumables presented in material form, if protective elements such as packaging, tape, seal, package are opened after delivery of the goods.

3. Contracts regarding the delivery of goods whose protective elements such as packaging, tape, seal, package have been opened after delivery and whose return is not suitable for health and hygiene reasons (underwear, swimsuits, etc.).

After delivery, the Customer may inspect the products in person to determine their condition, features, and functionality. Handling products in an acceptable manner is a reasonably acceptable process in e-commerce. If the Customer's inspection exceeds this reasonable level and the products are damaged or their value diminishes, shopderin.com may deduct this difference from the refund to be made to the Customer upon exercise of the right of withdrawal, or the Customer may be required to pay shopderin.com an amount equivalent to the diminished value of the products.

The Customer must return the products to shopderin.com along with the original packaging, instructions, and other documentation. In all cases, when returning the product, the Customer must include the invoice received upon delivery or any relevant document required by invoice regulations. A summary of how to exercise the right of withdrawal will be shared with the Customer upon receipt of the order. The Customer must return the product in the same packaging, in accordance with the instructions in the "RETURNS" section of the website.

None of the above options will incur any additional costs for the Customer. If the Customer chooses not to use any of the available free return methods, they must bear the return costs. If the Customer wishes to return the products to shopderin.com, the Customer may be responsible for any associated costs. After inspecting the products, shopderin.com will inform the Customer of their right to a refund of the amounts paid. Refunds will be made when the right of withdrawal is exercised within the legal period and all products comprising the relevant package are returned. Refunds will be made as soon as possible and, in any case, within fourteen (14) days from the date shopderin.com is notified of the intention to withdraw. Refunds will always be made using the same payment method used for the purchase. The Customer is responsible for the risks associated with returning the products as described above.

The Customer will be refunded, including any costs incurred in returning the product. Any money received from the Customer will always be refunded to the credit card used by the Customer to pay for the order. This provision will not prejudice your legal rights.

16. Liability and Disclaimer

Nothing in these Terms and Conditions shall in any way limit or exclude shopderin.com's liability for: 1. death or personal injury caused by shopderin.com's negligence; 2. fraud or false representation; or 3. any other circumstance in which it would be unlawful or unlawful for shopderin.com to limit or exclude its liability, or to attempt to do so. shopderin.com shall be liable to the Customer for loss or damage that is foreseeable through its own conduct. If shopderin.com fails to comply with these terms, it shall be liable for loss or damage to the Customer that is a foreseeable consequence of the breach of the Contract or the failure to use reasonable care and skill; however, shopderin.com shall not be liable for any loss or damage that is not foreseeable. A loss or damage shall be foreseeable if it is obvious that it will occur, or if both shopderin.com and the Customer knew it might occur when the Contract was entered into, for example, if the Customer discussed it with shopderin.com during the sales process. shopderin.com will not be held liable for any commercial losses. shopderin.com offers products for individuals and personal use only. If the Customer uses the products for any commercial, business, or resale purpose, shopderin.com will not be liable to the Customer, and the Customer acknowledges, represents, and agrees not to hold shopderin.com liable for any lost profits, lost business, business interruption, or lost business opportunity. The Customer acknowledges, represents, and agrees not to hold shopderin.com liable for any commercial losses. Due to the potential for errors in the storage and transmission of digital information through this website and its use, shopderin.com makes no warranty or guarantee regarding the accuracy or security of any information transmitted or obtained through it, unless expressly stated otherwise on the website. The Customer acknowledges that the copyright, trademarks, and all other intellectual property rights in all materials and content provided as part of the Website remain at all times owned by shopderin.com or its authorized agents. The Customer is permitted to use the submitted content only as expressly authorized by shopderin.com or its authorized agents. This does not preclude the Customer from using the Website to the extent necessary to obtain a copy of any order or Contract information.

18. Viruses, Cyber ​​Piracy and Other Cybercrimes

The Customer undertakes to refrain from misusing this website by knowingly uploading viruses, Trojans, worms, logic bombs, or other malicious or technologically harmful materials. The Customer will not attempt to gain unauthorized access to this website, the server hosting this website, or any server, computer, or database related to the website, nor will they attempt to disrupt, damage, destroy, or alter data. The Customer undertakes not to attack the website via a denial-of-service attack or a distributed denial-of-service attack. 20. Written Communication

Current legislation requires that certain information and messages sent by shopderin.com to the Customer be in writing. By using the website, the Customer agrees that communication with shopderin.com will primarily be electronic. By contacting the Customer via email or posting notices on the website, shopderin.com will inform the Customer. Pursuant to this Agreement, the Customer agrees to this electronic communication method and declares that all agreements, notices, information, and other communication methods provided to the Customer electronically comply with any legal requirements requiring such communication channels to be in writing. This condition does not affect the Customer's legal rights.

21. Notifications

All notices given to shopderin.com must be in writing. Subject to and as specified in Article 20, the Customer expressly acknowledges and agrees that shopderin.com may notify the Customer via the email or postal address provided by the Customer when placing an order. Notice shall be deemed to have been received and properly served immediately upon posting on the website, within 24 hours of sending an email, or within three days of sending a letter. In the case of a letter, the fact that the letter was sent to the appropriate address, sealed, and deposited at the post office shall be sufficient proof of receipt. In the case of an email, the fact that the email was sent to the relevant email address shall be sufficient proof of receipt.

22. Transfer of Rights and Obligations

This Agreement between shopderin.com and the Customer shall be binding on shopderin.com and the Customer, as well as on their successors. The Customer may not transfer, assign, subcontract, or delegate the Agreement, or any rights or obligations arising therefrom (except for the warranty), without prior written consent. However, the Customer may transfer shopderin.com's warranty under Section 15.4 to the person acquiring the product. shopderin.com may require the Customer to provide reasonable evidence that the person to whom the warranty is assigned is the current owner of the relevant product. For example, proof of purchase or receipt of a letter or chain of letters from the original Purchaser or subsequent Purchasers (as applicable) certifying that they have transferred their rights under the warranty to the new owner of the product is acceptable. shopderin.com may transfer, assign, subcontract, or delegate the Agreement, and any rights or obligations arising therefrom, at any time during the term of the Agreement. 23. Force Majeure

shopderin.com cannot be held responsible or liable for events beyond shopderin.com's control that cause it to fail to perform or delay any of its obligations under this Agreement and therefore constitute force majeure under the Agreement. Events beyond shopderin.com's control include acts, events, failures, omissions or accidents beyond reasonable control and include in particular (without limitation): 1. Strikes, lockouts or other industrial action. 2. Civil unrest, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war. 3. Fire, explosion, storm, flood, earthquake, collapse, epidemic or other natural disasters. 4. Impossibility of the use of railways, sea routes, air routes, motor vehicles or other public or private means of transport. 5. Impossibility of the use of public or private telecommunications networks. 13 6. Any government action, decree, legislation, regulation or restriction. 7. Any strike, crash or accident in the cargo, mail or other related transportation business. Any obligation of shopderin.com under any Contract shall be suspended for as long as the event beyond its control continues, and such period shall be added to the period for which shopderin.com is to perform the obligation. shopderin.com shall use all reasonable efforts to terminate the event beyond its control or to find a solution which will enable it to perform its obligations under the Contract despite the event beyond its control.

24. Waiver

Shopderin.com's failure during the term of the Agreement to ensure full performance by the Customer of any of its obligations under the Agreement or any other terms and conditions, or its failure to exercise any of its rights or remedies under the Agreement, shall not constitute a waiver of such rights or remedies, nor shall it constitute a waiver of such obligations by the Customer. Waiver of any default shall not constitute a waiver of any subsequent default arising under the Agreement or the Terms. No waiver of any of these Terms shall be deemed to be a waiver unless such waiver is expressly stated and communicated in writing in accordance with the paragraph in the Notices section above.

25. Divisibility

If any provision of these Terms or the Agreement is determined by any competent authority to be invalid, unlawful or unenforceable, such term, condition or provision shall be severed from the remaining terms, conditions or provisions, and the remainder shall remain valid to the fullest extent permitted by law.

26. Our Right to Change the Terms

shopderin.com reserves the right to update or modify these Terms from time to time. When using this website or ordering products from shopderin.com, the Customer shall be subject to the policies and Terms in effect, unless otherwise amended. Any potential changes to the Terms or Privacy Statement made by law or governmental authority will also apply to orders previously placed by the Customer. This change will not affect the Customer's statutory rights.

27. Competent Court

shopderin.com reserves the right to update or modify these Terms from time to time. Contracts related to the use of the website and the purchase of products through this website shall be governed by the laws of the Republic of Turkey. Any dispute arising from or related to the use of the website or such Contract shall be subject to the jurisdiction of the courts of Turkey. If a dispute arises regarding the contract between shopderin.com and the Customer, the Customer may file the necessary applications with the competent Consumer Court or Consumer Arbitration Board. Nothing in this clause affects the Customer's legal rights in this regard.
